Terms and Conditions

The operator of the e-shop and website  www.koupitobraz.cz  is a person (self-employed) and painter itself:  Mgr. Kateřina Ďoubalová, DiS.

"Atelier Kateřina & Max" - Mgr. Kateřina Ďoubalová, with registered office: Růžová 811, 284 01 Kutná Hora, Czech Republic, identification number: 641 63 580, entered in the commercial register, commercial register no. 320501-8361-00, issued by: Kutná Hora Municipal Office - trade office, no. MěŽÚ/3048/00 and further business according to special regulations on the basis of a restoration license - restoration permit, issued by the Ministry of Culture of the Czech Republic under number: 5244/2000.

Please note that in our e-shop you will only and exclusively purchase original works of art, original paintings or original graphic, created directly by the seller:).

Terms and Conditions

(the "Terms") 

1. The Parties

The Terms govern a relationship between the parties to a purchase agreement, which on one hand is Mgr. Kateřina Ďoubalová, DiS.(hereinafter referred to as the "Seller"), and on the other hand, the buyer (the "Buyer").

By confirming an order, the Buyer confirms that he is familiar and agrees with these Terms.

2. The Subject

The Subject of the contract is exclusively a work of art, an original author's work (the "Artwork"), which is created by the Seller.

3. Purchase contract

The contract is concluded by mutual agreement of both parties. The purchase contract becomes effective at the moment the order is sent by the buyer and the order is confirmed by the seller, and after the payment and shipping conditions are specified.

4. The Price

The purchase price of the Artwork is listed in Euros (EUR) on the site e-shop. The price does not include shipping costs.

5. Shipping

Artworks are packed properly and insured. Depending on the place of delivery, we choose the most suitable transport (unfortunately, sometimes shipping is more expensive than the painting itself). We will inform you of the shipping price in advance, before shipping. (notice: If you prefer certain way of transportation, please let us know in the comment field while ordering.)

We will also inform you about shipping and expected delivery date.

Shipping costs abroad within the EU 10-45 EUR

Shipping costs outside the EU 40-150 EUR

The prices are indicative, depending on the size of the artwork, weight, insurance price and the chosen method of transport.

The Seller reserves the right to change the prices published on the Site without prior notice.

6. Payment Methods

You can pay in cash or by bank transfer. Payment in cash is possible upon personal contact at the address of the atelier. Cash on delivery outside the Czech Republic is not possible.

If you chose bank transfer, please send the amount owed to account no. 2136394001/5500 (Raiffeisen Bank, as). The owner of the account is Kateřina Ďoubalová (the "Seller"). The Seller is not a VAT payer.

If the payment is cross-border, use the following – IBAN: CZ85 5500 0000 0021 3639 4001, BIC/SWIFT: RZBCCZPP.

Please use the order number as variable symbol.

An amount is considered paid on the date when it is credited to the Seller's Bank account. In case of non-payment within a reasonable period, the order will be automatically cancelled.

7. Delivery conditions

The Seller sends the Artwork to the address specified by the Buyer. Artwork will be sold to ship within 10 business days of full payment of the purchase price by the Buyer. If the Artwork is damaged during delivery, the buyer shall immediately inform the seller and the courier or transport company. Subsequently, the procedure is carried out according to the applicable legal regulations and according to mutual agreement.

8. Complaints

The buyer is entitled to exercise his rights from defective work within the statutory period. The Seller is responsible to the Buyer for the perfect Artwork upon delivery. On the other side, the buyer acknowledges that he is buying a unique author's artwork, that means the complaint does not apply author's interventions that are part of the Artwork. The complaint also does not apply to secondary damage caused by poor handling or wrong installation of the Artwork.

9. Withdrawal from the contract

The Buyer has the right to withdraw from a purchase contract without providing any reason and without any penalty within 14 days of delivery of the Artwork. The Buyer then bears the cost associated with returning the Artwork. The Seller is entitled to withdraw from the contract if the Buyer breaches the contract or the Terms.

10. Personal data

All data that the Seller receives in connection with the contract is confidential and will be used only for the execution of the purchase contract. The data will not be published or made available to third parties, except for persons involved in the delivery of the Artwork to the Buyer and the payment. The Buyer grants his consent to the collection and processing of personal data for purposes of execution of the purchase contract.

11. Final Provisions

In the event that any provision of these Terms is for any reason invalid or unenforceable, it does not cause invalidity or ineffectiveness of other parts of the Terms or any purchase contract. The Terms may be modified or supplemented, such amended Terms are effective from the date of publication. If the relationship of the purchase contract includes an international element, the Parties agree that the relationship is governed by Czech law.

These Terms come into effect on May 1, 2023.
